Terms and Conditions of Hire
1. In This Agreement:
a. Equipment – Means any kind of equipment, vehicles or tools including but not limited to landscaping and gardening; earthmoving; compaction; concrete & masonry; materials handling; vehicles including trucks, vans and trailers, and includes tools and parts and accessories for any of the foregoing.
b. Hire Agreement – means this agreement.
c. Hire Period – means an indefinite period of time. It commences on the earlier of: (i) When the Hirer takes possession of the equipment; or (ii) The time the Owner delivers the equipment to the address requested by the Hirer. The hire period ends when the Owner's office is advised, and all equipment returned no later than 8am on the following day.
d. Hirer – means any person, Company, Corporation or Government instrumentality who hires any equipment from the Owner.
e. Owner – means Hillview Hire Sand & Soil Pty Ltd and its assigns.
2. The Owner owns the equipment in all circumstances. The Owner retains title to the equipment even if the Hirer goes into liquidation or becomes bankrupt during the Hire Period.
3. The Hirer is not entitled to offer, sell, assign, sub-let, charge, mortgage, pledge or create any form of security interest over, or otherwise deal with the equipment in any way.
5. In addition to the Hire Charges, the Hirer agrees to pay for: consumables, fuel, or trade materials supplied; delivery, collection or installation costs; cleaning and repair charges if equipment is not returned in clean and good working condition; any stamp duty or GST; any applicable levies, fines, penalties and government charges.
6. If the Hirer does not pay the invoice in full by the due date, the Owner may charge interest at 16% per day on the outstanding balance, plus any costs incurred in recovering unpaid amounts.
7. If equipment is broken down, lost, stolen or damaged beyond fair wear and tear, the Hirer will be liable for all recovery, repair or replacement costs plus hire charges during that period.
8. The Hirer shall supply all fuel required for the efficient operation of the equipment.
12. The Hirer agrees that before taking delivery they have satisfied themselves as to the suitability and condition of the equipment. The Owner makes no representations that the equipment is suitable for the Hirer's intended purpose.
13. The Hirer must: operate the equipment safely and in accordance with all laws; ensure operators are suitably trained and qualified; ensure no persons operating the equipment are under the influence of drugs or alcohol; conduct a job safety analysis prior to use.
14. If equipment breaks down the Hirer must immediately stop using it, notify the Owner, and not attempt to repair it without the Owner's consent.
22. This Hire Agreement is governed by the laws of Victoria.

How to correctly backfill a retaining wall
Getting your retaining wall drainage right is the most important part of building a long-lasting wall. Follow these steps and your wall will handle water properly for years to come.
1
Lay the geotextile fabric
Line the trench with geotextile fabric — run it along the back of the wall, down the trench face and across the bottom. Leave plenty of excess at the top — you'll need it to fold back over later to create a filter envelope that stops soil contaminating your drainage rock.
2
Lay the 100mm ag pipe
Place the 100mm slotted ag pipe on the trench floor behind the base of the wall. Holes face down — water rises up from underneath and enters through the perforations. Make sure the pipe has a slight downward slope (minimum 1:100) toward a stormwater outlet. You can lay a 50mm bed of 20mm aggregate under the pipe first for extra drainage.
Products needed: 100mm Ag Pipe · 20mm Aggregate (optional bedding)

Backfill with 20mm aggregate
Pour 20mm aggregate over and around the ag pipe to create your drainage column. Extend the rock at least 300mm wide directly behind the wall, and bring it up the back of the wall until it's roughly 200–250mm below your final finished ground level.

Seal the fabric envelope
Pull the excess geotextile fabric from the back of the trench forward and fold it completely over the top of the aggregate column, overlapping against the back of the retaining wall. This seals the drainage rock inside a filter envelope and prevents clay and topsoil from migrating down into the clean aggregate over time.

Cap with a clay layer
Place a 100mm layer of compacted clay directly over the sealed fabric. This acts as a water barrier, stopping surface rainwater from soaking straight down into the drainage zone next to the wall. It forces water to shed away from the wall instead — exactly what you want.
6
Finish with topsoil
Fill the remaining 100–150mm to the top of the wall with premium topsoil, ready for lawn or garden beds. Slope the topsoil gently away from the wall to prevent water pooling against the structure.

How to apply mulch & bark correctly
Mulch and bark are one of the best things you can do for your garden — but only if you apply them correctly. Here's how to get the best results from your Hillview mulch.
Apply at 75–100mm depth
This is the sweet spot. Too thin and sunlight gets through, triggering weed growth. Too thick and it can suffocate your soil and stop rainwater reaching plant roots.
Keep away from plant trunks
Leave a 50mm gap around the base of trees and plant stems. Packing mulch against bark traps moisture and causes rot and fungal disease over time.
Remove existing weeds first
Mulch smothers weed seeds but established weeds will push straight through it. Weed the area thoroughly before you spread your mulch.
Water the soil beforehand
Apply mulch to damp soil. If you spread it over bone-dry ground, the mulch can absorb light rainfall like a sponge and keep the soil dry underneath.
Top up every 12–18 months
Organic bark and mulch break down over time, which improves your soil structure. Add a 25–50mm top-up every 12 to 18 months to maintain the ideal depth.
